Definition of a dealer

A trader is a natural or legal person who runs a business. A business is any permanent activity carried out on one’s own account and responsibility that is aimed at making a profit and is not necessarily of a freelance or agricultural nature.

The definition of a trader arises from trade law, which in Germany is regulated at state level by various trade regulations. As a result, tradespeople must generally register their business with the relevant authority and meet certain requirements, such as a reliability check.

As a tradesperson, you are generally free to choose your activity, provided that it does not violate legal regulations or common decency. However, tradespeople are also subject to certain obligations, such as the obligation to keep accounts, the obligation to pay trade tax or the obligation to comply with occupational health and safety regulations.
