General Terms and Conditions of Business and Travel
1. Registration
By registering, the customer offers the tour operator to conclude a travel contract. Registration can be made in writing, by fax or by email. The travel contract is concluded with the booking confirmation, which can be sent to the participant by fax, email or post. The travel contract is concluded with the confirmation from the organizer, which can be made in any form. If the content of the booking confirmation differs from the registration, this constitutes a new offer from the tour operator, to which the tour operator is bound for 10 days. The new contract is concluded on the basis of the new offer if the participant declares acceptance within the 10-day binding period. The tour operator is bound to the new offer.
2. Payment, remaining amount
Upon receipt of the booking confirmation, a deposit of 20% of the travel price is due and payable after presentation of the security certificate in accordance with Section 651k Paragraph 3 of the German Civil Code. The remaining amount is to be paid no later than four weeks before the start of the trip without a separate request. If there is a period of less than four weeks between booking and the start of the trip, the entire travel price is due within one week. Payment of the travel price is made by bank transfer to the account mentioned.
3. Rebookings, services and price changes
The scope of the contractual services is set out in the travel descriptions on the homepage.
A) If changes are made to the travel date at the customer’s request after booking the trip (rebooking), ONE-Motortours UG (limited liability) is entitled to charge a processing fee of €30.00, provided that a rebooking is even possible.
B) Changes or deviations to individual travel services that become necessary after the contract has been concluded and were not brought about by the organizer in bad faith are only permitted if the format of the booked trip is not significantly changed as a result. A significant change to the format of the trip does not occur, in particular, if the changes are due to weather conditions. The tour operator reserves the right to change the route slightly and to replace planned hotels, excursion destinations, locations, restaurants and cafés/bars with equivalent ones. If the traveler does not use any services after the start of the trip or if the traveler requests an early return trip, there is generally no right to a refund of the pro rata travel price, the event, accommodation or entrance fees.
C) Price changes may be possible after the travel contract has been concluded, provided the organizer is not responsible for them, such as changes to port or airport fees, or a change in the exchange rates or taxes applicable to the trip in question, to a reasonable extent if more than four months have passed between the conclusion of the contract and the start of the trip. If the increase is more than 5% of the agreed booking fee, the participant is entitled to withdraw from the travel contract within 10 days. In this case, the participant will receive a refund of the travel price paid up to that point.
4. Accommodation and hotel
The hotels and accommodations offered are all typical of the country and are of a good standard, with single rooms and full board. If the destination hotels/accommodations cannot be reached due to weather conditions or circumstances that are outside the control of the tour operator, no claims for damages can be made. Any additional costs incurred as a result of this will be borne by the participant.
5. Requirements for participants, obligation to cooperate, ban on riding along
A) Every traveler must prove that they have a category A driving license. Every participant is obliged to inform themselves about the entry requirements before the trip and, if necessary, to apply for a visa. If, contrary to expectations, the travel documents have not been received by the travel participant at least seven days before the start of the trip, they must contact ONE-Motortours UG (limited liability) immediately.
B) The traveler is obliged to cooperate within the framework of the legal provisions in the event of service disruptions, to avert or minimize any damage. The travel participant is particularly obliged to report his complaints to the organizer immediately and to give him a reasonable amount of time to remedy the situation. If the participant culpably fails to report a defect, he is not entitled to a reduction. Any claims must be submitted in writing to the tour operator within one month of the end of the tour. If the participant does not meet these requirements, the respective tour guide is entitled to terminate the travel contract without prior notice. Each participant is obliged to only start the trip in good health and to comply with the health regulations and vaccination requirements of the respective countries.
C) ONE-Motortours UG (limited liability) reserves the right to exclude participants from a trip if they are not in good mental or physical condition, e.g. due to illness, alcohol or drug use. In this case, they will travel in the support vehicle and can therefore continue to take part in the trip. If the travel participant does not comply with traffic regulations or the terms and conditions of the group trip, the organizer can declare the contract invalid and, if necessary, confiscate the rental motorcycle. In such a case, no refund of the trip will be made. If a participant violates protective regulations or if the other participants or the proper conduct of the event are endangered or injured or damaged by their behavior, the representatives of ONE-Motortours UG (limited liability) have the right to exclude the participant from the rest of the event after prior warning. Furthermore, the participant is liable for damage caused by them within the framework of the statutory provisions.
6. Cancellation of trip
A) by the participant before the start of the trip
The participant is entitled to withdraw from the travel contract at any time before the start of the trip. If the participant declares withdrawal from the travel contract, the following cancellation fees apply. The compensation is calculated according to the time of receipt of the cancellation notice in a percentage ratio to the travel price as follows:
• for cancellation up to 45 days before the start of the trip, 25% of the travel price.
• for cancellation up to 31 days before the start of the trip, 50% of the travel price.
• for cancellation up to 14 days before the start of the trip, 75% of the travel price.
• for cancellation up to 7 days before the start of the trip, 90% of the travel price.
• for cancellation up to less than 7 days before the start of the trip, 100% of the travel price.
• for no-show on the day of the trip, 100% of the travel price.
The tour operator is entitled to claim higher compensation if the aforementioned flat rates do not cover the actual costs incurred. If the participant proves to the organizer that he actually suffered less damage, the tour operator can only claim this less damage. Costs such as visa, telephone or processing costs cannot be reimbursed in the event of cancellation of the trip.
ONE-Motortours UG (limited liability) recommends taking out travel cancellation insurance. This can cover the cancellation costs for the insured risks in accordance with its insurance conditions.
B) by the participant after the start of the trip
The participant may only terminate the travel contract if the participant has given the tour operator a reasonable period of time to remedy the defect; unless the remedy is impossible or is refused by the tour guide appointed by the tour operator or the immediate termination of the contract is justified by a special interest of the participant.
C) due to unavoidable, extraordinary circumstances
According to Section 651 h Paragraph 3 Sentence 2 of the German Civil Code (BGB), circumstances are unavoidable and extraordinary if they are beyond the control of the tour operator and their consequences could not have been avoided even if all reasonable precautions had been taken. The existence of such circumstances must be examined on a case-by-case basis. According to Section 651 h Paragraph 2 of the German Civil Code (BGB), the tour operator cannot demand appropriate compensation if the traveler withdraws if unavoidable, extraordinary circumstances occur at the destination or in its immediate vicinity that significantly affect the implementation of the trip or the transport of people to the destination. According to Section 651 h Paragraph 4 Sentence 2, the tour operator can withdraw from the contract before the start of the trip if it is prevented from fulfilling the travel contract due to unavoidable, extraordinary circumstances. In this case, it must declare the withdrawal immediately after becoming aware of the reason for withdrawal. If the traveler withdraws, he loses the right to the agreed travel price.
The participant must notify the organizer of any claims for defects, damages or reductions within one month of withdrawal. If this deadline is not met, the participant cannot assert any claims.
D) if the number of participants is too low
The organizer is entitled to withdraw from the travel contract within a period of four weeks at the latest before the start of the trip if the minimum number of participants specified for the respective trip is not reached. This is generally the case unless at least five drivers are taking part in the trip.
7. Liability
The organizer is liable within the framework of a UG (limited liability) for the conscientious travel preparation, selection and monitoring of the service providers and the proper provision of the contractually agreed travel services.
The organizer’s liability under the respective travel contract for damages that are not physical injuries is limited to an amount equal to the travel price, provided that the damage is only caused by slight negligence on the part of the organizer or a vicarious agent or if the organizer is solely responsible due to the fault of a service provider.
The organizer is only liable for personal injuries if he is at fault. The organizer’s liability is excluded or limited to the extent that international agreements permit this or to the extent that an exclusion of liability is permitted under the legal provisions of the respective country. Liability for a service provider commissioned by the organizer is also excluded if the aforementioned national provisions or international agreements are applicable to the services to be provided by the service provider.
Each travel participant is personally liable for accidents caused by themselves.
All compensation for damages caused by the transport of a travel participant’s luggage in the ONE-Motortour support vehicle is excluded.
8. Compliance with instructions
Every participant is obliged to comply with the laws of the respective country and the regulations applicable to group travel. In case of doubt, the tour guide’s instructions must be followed. If a participant does not comply with these regulations despite prior warnings from the tour guide, violates protective regulations or endangers, injures or damages the other participants or the proper execution of the trip through their behavior, the respective tour guide is entitled to exclude the participant from further participation in the trip without granting them a refund of the travel price. The additional costs incurred as a result must be borne by the participant themselves.
9. Identity of the operating air carrier
If the travel contract includes transport by air, the traveler will be informed of the identity and name of the operating air carrier for all air transport services to be provided as part of the booked trip when booking. If the identity of the air carrier is not yet known at the time of booking the trip, the traveler will be informed of the airline or airlines that are likely to operate the flight or flights and the traveler will be informed immediately as soon as this is finally known. If the airline notified to the traveler changes, the tour operator must inform the traveler of the change immediately. The tour operator must take all reasonable steps to ensure that the traveler is informed of the change as soon as possible.
10. Miscellaneous
The participant must notify the organizer of any claims for defects, damages or reduction within one month of withdrawal. If this deadline is not met, the participant cannot assert any claims.
The participant’s claims for physical injury for which the organizer or one of its service providers is responsible and which is based on a negligent or intentional breach of duty expire within 12 months. The limitation period begins on the day on which the trip should end according to the contract.
These conditions apply unless individual agreements are made in the individual travel contracts.
When selling goods and products of any kind by ONE-Motortours-Offroad-Nature-Experience UG (limited liability), ONE-Motortours UG (limited liability) reserves ownership of the goods until all claims from the current business relationship have been fully settled. The invalidity of individual provisions does not result in the invalidity of the entire travel contract.
The organizer is entitled to use the photos and videos taken on the tours for advertising purposes, homepage, social media, as far as this is legally permissible. Any further use is not permitted if the customer objects. The travel participant cannot make a claim to a fee.
The invalidity of individual provisions does not result in the invalidity of the entire travel contract. The same applies to the travel and business terms and conditions. By registering, the customer accepts these provisions as binding. The organizer reserves the right to correct printing and calculation errors.
11. Place of jurisdiction and choice of law
The place of jurisdiction for disputes arising from the contractual relationship is the registered office of the organizer. Only German law applies to the legal relationship between the organizer and the participant. The place of jurisdiction is the registered office of the organizer.
